Kansas uses the term 'resident agent.' Under the Business Entity Standard Treatment (BEST) Act, every covered entity must maintain a resident agent, which may be the entity itself, an individual resident of Kansas, a domestic entity (corporation, LP, LLP, LLC, or business trust), or a foreign entity of those types. After a resident agent's resignation becomes effective with no successor designated, service of legal process on the entity is made upon the Secretary of State in the manner prescribed by K.S.A. 60-304. Similarly, if the agent dies or moves and no new agent is designated within 30 days, service may be made as prescribed by K.S.A. 60-304 (17-7926(b)).

The regime

Kansas has no general assumed-name / DBA / fictitious-business-name registration act. Nothing in the Kansas corpus (General Corporation Code, LLC Act, partnership acts, BEST Act, or chapter 81) requires or provides a DBA filing for sole proprietors, partnerships, or entities, and the retrieval manifest records the Kansas Secretary of State's confirmation that state law neither requires nor permits DBA/fictitious-name registration. What does exist is the voluntary Revised Kansas Trademark Act (K.S.A. 81-201 et seq.), under which a person using a trademark or service mark may register the mark with the Secretary of State; 'trade name' is defined in the act but its registration provisions apply to marks.

Where it is filed

There is no DBA filing office in Kansas because there is no DBA registration act. The only adjacent state registry is the Secretary of State's voluntary trademark / service-mark register under the Revised Kansas Trademark Act.

Assumed names for registered entities

Kansas entity law contains no assumed-name filing mechanism and, unusually, no fictitious-name adoption for foreign entities whose real name is taken. Under the Business Entity Standard Treatment Act, domestic covered-entity names must be distinguishable on the Secretary of State's records (K.S.A. 17-7918), and a foreign covered entity whose name conflicts may register only with the other registrant's written consent or by identifying its state of formation in its advertising - it does not adopt a Kansas fictitious name.
